Yeswegays.com (“Yeswegays,” “we,” “us,” or “our”) respects the intellectual-property rights of others and requires users of the Service to do the same.
Yeswegays.com is a user-generated content (“UGC”) video-sharing and hosting platform. Visual content appearing on the Service is submitted and uploaded by independent third-party users (“Submitters” or “Users”). Yeswegays.com does not itself create, commission, film, photograph, or participate in the original production of User Submissions.
This DMCA Notice & Takedown Policy describes the procedures for submitting copyright infringement notifications and counter-notifications concerning material available through Yeswegays.com.
Yeswegays.com intends to respond appropriately to copyright infringement complaints and to comply with applicable copyright laws and legally applicable notice-and-takedown requirements.
Nothing in this Policy constitutes an admission or representation that any particular statutory protection, limitation of liability, safe harbor, defense, or immunity applies to Yeswegays.com in any particular circumstance.
The governing-law and jurisdiction provisions in our Terms of Use do not displace any statutory notice-and-takedown or counter-notification procedure that applies under applicable law.
1. COPYRIGHT INFRINGEMENT NOTIFICATIONS
If you are a copyright owner, or are authorized to act on behalf of a copyright owner, and believe that material available through the Service infringes a copyright, you may submit a written copyright infringement notification through the copyright reporting or contact mechanism provided on Yeswegays.com.
To enable us to identify and process the complaint, the notification should include substantially the following information:
- A physical or electronic signature of the copyright owner or a person authorized to act on the copyright owner's behalf.
- Identification of the copyrighted work claimed to have been infringed or, if multiple copyrighted works are covered by one notification, a representative list of those works.
- Identification of the material claimed to be infringing or to be the subject of infringing activity and that you request be removed or access to which you request be disabled, together with information reasonably sufficient to permit Yeswegays.com to locate the material. Whenever reasonably available, please provide the specific Yeswegays.com URL for each item at issue.
- Information reasonably sufficient to permit us to contact you, such as your name, mailing address, telephone number, and email address.
- A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the copyright owner.
Notices that do not contain sufficient information may be delayed, rejected, or require additional information before they can be processed.
Copyright complaints should concern copyright infringement. Reports concerning CSAM, suspected minors, trafficking, non-consensual intimate imagery, or emergencies should be submitted through the appropriate reporting mechanisms described in Section 9.
2. PROCESSING OF COPYRIGHT NOTICES
Upon receipt of a sufficiently complete copyright infringement notification, Yeswegays.com may review the notice and take appropriate action, including disabling access to or removing identified material where appropriate.
Where appropriate and consistent with applicable law, Yeswegays.com may notify the affected User or Submitter that the material has been removed or disabled.
Yeswegays.com may request additional information where reasonably necessary to identify the material, evaluate the notification, prevent fraud or abuse, or comply with applicable law.
Yeswegays.com may also take action under its Terms of Use independently of any copyright notification.
Removal or disabling of material in response to a notification does not constitute an admission by Yeswegays.com that the material infringes copyright or that Yeswegays.com is legally responsible for the material.
3. COUNTER-NOTIFICATIONS
If material you submitted was removed or disabled following a copyright infringement notification and you believe that the material was removed or disabled as a result of mistake or misidentification, you may submit a written counter-notification through the copyright reporting or contact mechanism provided on Yeswegays.com.
A counter-notification should include substantially the following:
- Your physical or electronic signature.
- Identification of the material that was removed or to which access was disabled and the location at which the material appeared before it was removed or disabled.
- A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, telephone number, and email address.
- Where applicable to the procedure being invoked, a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located or, if your address is outside the United States, to the jurisdiction of an appropriate United States Federal District Court, and that you will accept service of process from the person who submitted the original notification or that person's agent.
Counter-notifications containing knowingly false or materially misleading statements may expose the sender to legal liability.
4. ACTION FOLLOWING A COUNTER-NOTIFICATION
After receiving a sufficiently complete counter-notification, Yeswegays.com may provide a copy to the person who submitted the original copyright infringement notification where appropriate or required by applicable law.
Where the applicable statutory procedure requires or permits restoration, material may be restored or access to it re-enabled in accordance with applicable legal requirements.
Where the procedures under 17 U.S.C. § 512(g) apply, restoration may occur not less than 10 nor more than 14 business days following receipt of a compliant counter-notification unless notice is received that the complaining party has filed an action seeking a court order to restrain the User or Submitter from engaging in infringing activity relating to the material.
Nothing in this Policy requires Yeswegays.com to restore material where continued removal or restriction is independently authorized under our Terms of Use or applicable law.
5. REPEAT COPYRIGHT INFRINGEMENT
Yeswegays.com may, in appropriate circumstances and subject to applicable law, suspend or terminate accounts of Users determined to be repeat copyright infringers.
Yeswegays.com may also restrict, suspend, or terminate accounts for other violations of its Terms of Use, including submission of unlawful or prohibited material.
6. MISREPRESENTATIONS AND ABUSE OF THE COPYRIGHT COMPLAINT PROCESS
Do not submit fraudulent, abusive, knowingly false, or materially misleading copyright infringement notifications or counter-notifications.
Under applicable law, including 17 U.S.C. § 512(f) where applicable, persons who knowingly make certain material misrepresentations concerning copyright infringement or concerning removal by mistake or misidentification may be subject to liability.
Yeswegays.com may take appropriate action regarding misuse of its reporting or compliance procedures.
7. USER AND SUBMITTER RESPONSIBILITY
Submitters are responsible for ensuring that they possess all rights, licenses, permissions, releases, and legal authority necessary to upload and make their User Submissions available through the Service.
As further described in our Terms of Use, each Submitter represents and warrants that the Submitter owns the User Submission or otherwise possesses sufficient legal authority to upload and make it available through the Service.
The submission, hosting, transmission, storage, technical processing, moderation, restriction, or removal of User Submissions does not transfer ownership of the User Submission to Yeswegays.com.
Nothing in this Policy changes the allocation of responsibility for User Submissions described in our Terms of Use.
8. PRESERVATION AND DISCLOSURE OF INFORMATION
Yeswegays.com may preserve information relating to copyright notifications, counter-notifications, User Submissions, accounts, upload activity, complaints, disputes, investigations, or enforcement actions where reasonably necessary or permitted for legal compliance, fraud or abuse prevention, evidence preservation, dispute resolution, or the establishment, exercise, or defense of legal claims.
Information may also be disclosed where required or permitted by applicable law, valid legal process, court order, or lawful governmental or law-enforcement request.

9. OTHER CONTENT COMPLAINTS
This Policy is intended primarily for copyright infringement complaints.
Reports concerning suspected child sexual abuse material (“CSAM”), minors, sexual exploitation, trafficking, non-consensual intimate imagery, privacy violations, or other unlawful or prohibited material should be submitted through the appropriate reporting or compliance mechanisms available through Yeswegays.com, including any applicable flag or report function available on the relevant page.
Copyright infringement notifications should not be used as a substitute for reporting emergencies or suspected CSAM.
10. COPYRIGHT CONTACT
Copyright infringement notifications, counter-notifications, and other copyright-related communications may be submitted through the copyright reporting or contact mechanism provided on Yeswegays.com.
Please provide sufficient information for Yeswegays.com to identify the material at issue, contact you where reasonably necessary, and evaluate the request.
11. CHANGES TO THIS POLICY
Yeswegays.com may modify this Policy from time to time to reflect changes in applicable law, procedures, or the Service.
The current version will be made available through the Service with a revised “Last Updated” date.
12. RELATIONSHIP TO OTHER POLICIES
This Policy should be read together with our Terms of Use, Privacy Policy, and 18 U.S.C. §§ 2257 and 2257A Record-Keeping Requirements Compliance Statement.
Nothing in this Policy modifies responsibilities allocated to Users or Submitters under those policies except to the extent required by applicable law.
